Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Nuance: AI Perfume Finder mobile application and related services (collectively, the “App” or “Service”), operated by Nuance (“Nuance,” “we,” “us,” or “our”).

By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not use the App.

Description of Service

Nuance is an AI-powered perfume discovery and recommendation app that helps users explore fragrances based on personal preferences, mood, outfit, season, occasion, favorite perfumes, notes, accords, and related profile information.

Nuance does not sell perfumes directly. The App provides informational, preference-based recommendations to assist with fragrance discovery. Recommendations are not professional, medical, dermatological, or other specialist advice.

Eligibility

You must be at least 13 years old to use the App, or the minimum age required in your jurisdiction to consent to the use of online services, whichever is higher. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian.

By using the App, you represent that you meet these eligibility requirements and that you have the legal capacity to enter into these Terms.

Account Registration and Security

Certain features of the App may require you to create an account. When you register, you agree to provide accurate, current, and complete information and to keep that information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at support@trynuance.app if you suspect unauthorized access to your account.

We reserve the right to suspend or refuse registration, or to reclaim usernames, where permitted by law and reasonably necessary to protect the Service or other users.

User Preferences and Content

The App may allow you to submit, store, or generate information such as fragrance preferences, favorites, ratings, onboarding responses, mood selections, and other profile-related content (“User Content”).

You are solely responsible for the information you provide through the App. You represent that you have the right to submit such information and that your User Content does not violate applicable law or these Terms.

You grant Nuance a non-exclusive, worldwide, royalty-free license to use, store, process, reproduce, and display your User Content solely as necessary to operate, provide, maintain, and improve the App, including generating personalized recommendations.

AI Recommendations Disclaimer

Recommendations provided through the App are generated using automated systems, including artificial intelligence, based on the information you provide and available app data. Recommendations are suggestions intended to support personal fragrance discovery.

Recommendations may not always be accurate, complete, current, or suitable for every user. Fragrance preferences are subjective, and a suggested perfume may not match your expectations, skin chemistry, environment, or personal taste.

You agree to treat all recommendations as informational only and to use your own judgment before making purchasing or usage decisions. Nuance does not guarantee that any recommended fragrance will be available, affordable, safe for you, or appropriate for any particular purpose.

Subscriptions and Payments

Certain premium features of the App may require a paid subscription (“Subscription”). If you choose to purchase a Subscription, the applicable fees, billing period, and features will be presented to you before purchase.

Payments, renewals, cancellations, refunds, and billing disputes for Subscriptions are handled by the platform through which you purchased the Subscription — either the Apple App Store or Google Play — depending on your device and purchase method. Nuance does not process subscription payments directly and does not receive your full payment card details.

You can manage, cancel, or modify your Subscription through your Apple or Google account settings, in accordance with the policies of the applicable app store. Any refund eligibility is determined by Apple or Google, not by Nuance, except where applicable law requires otherwise.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

Use the App for any illegal, fraudulent, or unauthorized purpose
Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, underlying models, or non-public components of the App, except where such restriction is prohibited by applicable law
Scrape, crawl, harvest, or use automated means to access the App or extract data in a manner that exceeds normal individual use or violates these Terms
Attempt to disrupt, overload, interfere with, or compromise the security, integrity, or performance of the Service
Submit unlawful, harmful, abusive, misleading, infringing, or otherwise objectionable content
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Use the App in a way that violates the rights of others or applicable law

We may investigate and take appropriate action, including suspending or terminating access, if we believe you have violated these restrictions.

Intellectual Property

The App, including its design, software, branding, logos, text, graphics, algorithms, and other materials (excluding User Content), is owned by Nuance or its licensors and is protected by intellectual property and other applicable laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal use and other lawful purposes permitted by these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the App except as expressly permitted by law or with our prior written consent.

Fragrance names, brand names, and product references that may appear in the App may be trademarks of their respective owners. Nuance is not affiliated with or endorsed by any fragrance brand unless explicitly stated.

Third-Party Services

The App may rely on or integrate with third-party services, including analytics, attribution, advertising measurement, app store payment services, AI providers, and advertising partners. These services may include Supabase, OpenAI or other AI service providers, RevenueCat, PostHog, Meta/Facebook SDK, Google Analytics for Firebase, TikTok App Events SDK, and other infrastructure partners where applicable. Your use of those services may be subject to separate terms and privacy policies imposed by the relevant third party.

Nuance is not responsible for third-party services, websites, or content that are not controlled by us. Your interactions with third parties are solely between you and the applicable third party.

Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the App, you acknowledge that you have read and understood the Privacy Policy.

Account Termination

You may stop using the App at any time. Users can request account and data deletion by emailing support@trynuance.app from the email address associated with their Nuance account, with the subject line “Nuance Account Deletion Request”.

We may suspend or terminate your access to the App, in whole or in part, at any time if we reasonably believe you have violated these Terms, created risk or possible legal exposure for us or other users, or if we are required to do so by law. Where appropriate, we may provide notice before termination.

Upon termination, your right to use the App will cease immediately. Provisions that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, limitations of liability, and governing provisions.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the App and all content, recommendations, and services provided through the App are offered on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory.

Without limiting the foregoing, Nuance disclaims any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that recommendations will meet your expectations or that the App will be secure or free from defects.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

To the fullest extent permitted by applicable law, Nuance and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the App.

To the fullest extent permitted by applicable law, our total liability for any claim arising out of or relating to the App or these Terms will not exceed the greater of (a) the amount you paid for the App or Subscription through the applicable app store in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty U.S. dollars (USD $50), except where such limitation is prohibited by law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Changes to Terms

We may update these Terms from time to time to reflect changes to the App, our business practices, or applicable law. When we make material changes, we will provide notice as appropriate, such as through the App or by updating the “Last updated” date at the top of this page.

Your continued use of the App after updated Terms become effective constitutes your acceptance of the revised Terms, unless applicable law requires otherwise.
